Kodak hangs on to dear life as it tries its best not to file Chapter 11 bankruptcy. Its first draw is to sue Apple and HTC for patent infringement over a total of five Kodak’s patents.

The complaint, which was filed in the Western District of New York, accuses the two companies of infringing Kodak’s patent that relate to technology for transmitting images to an e-mail address. Kodak also alleges that some of HTC’s smartphones infringes a patent that involves technology in previewing images, something that Kodak has pending action against Apple.

Kodak seeks from the United States International Trade Commission (ITC) an exclusion order that would prevent the importation of Apple’s and HTC’s devices that infringe Kodak’s patents, including smartphones and digital cameras.
